01Agreement to These Terms
These Terms and Conditions govern your access to and use of KiwiTalk, including worldwide voice calling, live transcription, translation, suggested replies, and related services. By creating an account, accepting these Terms during onboarding, or using KiwiTalk, you agree to these Terms and our Privacy Policy.
If you use KiwiTalk for an organization, you confirm that you have authority to accept these Terms for that organization.
02Eligibility and Account Responsibility
- You must be legally able to enter into these Terms and meet the minimum age required in your country.
- You must provide accurate account information and keep your authentication credentials and devices secure.
- You are responsible for activity performed through your account unless you promptly report unauthorized access.
03Lawful and Responsible Use
You may use KiwiTalk only for lawful communication. You are responsible for understanding and following the laws, regulations, telecom rules, sanctions, and calling restrictions that apply to you, the person you call, and every country involved in a call.
- Do not use KiwiTalk for fraud, scams, phishing, extortion, harassment, threats, stalking, hate, exploitation, or other unlawful conduct.
- Do not impersonate another person or organization, falsify caller identity, or misrepresent the purpose of a call.
- Do not place illegal robocalls, unsolicited marketing calls, abusive high-volume calls, or calls that violate do-not-call and consumer-protection rules.
- Do not use the service to facilitate trafficking, terrorism, controlled-substance offenses, financial crime, sanctions evasion, or infringement of another person's rights.
- Do not interfere with KiwiTalk, probe its security, bypass limits, misuse credentials, or use automated systems in a way that harms the service or other users.
04Call, Transcription and Translation Consent
Calling, recording, transcription, and translation laws differ by location. Before using live transcription or translation, you must obtain every notice and consent required from all participants. KiwiTalk does not determine whether consent is required for a particular call.
You must not use generated transcripts, translations, summaries, or suggested replies as a substitute for professional medical, legal, financial, emergency, or other regulated advice.
If you are unsure whether a call may legally be recorded, transcribed, translated, or monitored, do not enable those features until you obtain qualified advice.
05Worldwide Calling
International call availability, caller identification, number reachability, quality, pricing, taxes, and regulatory treatment vary by destination, carrier, and local law. Some destinations or number types may be blocked or unsupported.
You are responsible for verifying the destination number and any charges or obligations associated with the call. We may restrict destinations, call patterns, or accounts to prevent abuse, fraud, security incidents, or legal violations.
06No Emergency Calling
Do not use KiwiTalk to contact emergency services such as police, fire, ambulance, coast guard, or equivalent services. Use your device's native telephone service or another locally approved emergency method.
KiwiTalk is not a replacement for your mobile or landline telephone service and must not be relied on for emergency calls.
07Third-Party Services and AI Output
KiwiTalk depends on third-party identity, telecom, cloud, speech recognition, translation, and infrastructure providers. Their availability and processing may affect the service.
Transcripts, translations, summaries, and suggested replies may be incomplete, delayed, or inaccurate. You must verify important information before relying on or acting on generated output.
08Suspension and Termination
We may limit, suspend, or terminate access when we reasonably believe an account presents abuse, fraud, security, legal, operational, or safety risk; violates these Terms; or creates harm for users, providers, or the public.
Where appropriate and legally permitted, you may contact us to request a review of an account restriction.
09Privacy
Our Privacy Policy explains how KiwiTalk handles account, call, audio, transcript, translation, diagnostic, and device information. You must not submit another person's information unless you have a lawful basis to do so.
10Availability and Changes
The service is provided on an as-available basis. We may maintain, change, suspend, or discontinue features, providers, destinations, or limits. We may update these Terms and will provide notice when required.
11Disclaimers and Liability
To the maximum extent permitted by law, KiwiTalk is provided without warranties of uninterrupted availability, error-free operation, or perfect transcription or translation accuracy. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
You are responsible for your communications, recipients, content, consents, and compliance. ClockHash is not responsible for decisions made solely from unverified generated output.
